Reporting Teacher Contracts The bill changes when school districts must annually present to each teacher and administrator a

Crime To Tear Down Road Barricades CCR A to HB2249 creates a fine of either $100 or $2,500 for persons who tears down, damages, or removes any traffic-control devices during an ongoing flooding event. Upon conviction, said person shall be guilty of a misdemeanor. The fine is increased to $2,500 if the person was transporting a child. The person is also subject to pay restitution and is liable for any damage to property or injury or death to persons caused by the violation.

Defining Indian Art By Federal Tribe Status HB2261, as introduced, modifies the definition of American Indian tribe, American Indian and authentic American Indian arts and crafts as it relates to the American Indian Arts and Crafts Act of 1974. The measure defines American Indian tribe as any Indian tribe federally recognized by the Bureau of Indian Affairs and defines American Indian as a citizen or enrolled member of an American Indian tribe. The measure also adds performing arts and literature to the list of authentic art that is enforced by the act.

Educational Definition Of Unborn Child CCS for HB 2797 creates the Humanity of the Unborn Child Act. The Department of Health is required to develop, annually update and maintain an electronic form with certain information. On or before January 1, 2018, the Department will make available certain signage to state specified facilities for posting. The Department will develop and make certain materials available, provide specified distributions, technical assistance, outreach, consultation and training, and recommend to the Department of Education certain scientifically verifiable information in the educational standards of science, family and consumer sciences and health classes. Contingent on availability of appropriated funds, the Department of Education, in collaboration with the Department of Health will establish an instructional program for students consistent with this act. Local school boards may choose to implement the specified instructional program. The content of instruction used by local schools for teaching will be at the discretion of the appropriate school board with required provisions. The Public Education on the Humanity of the Unborn Child Fund is created as a revolving fund for the State Board of Education. Department of Education personnel provide that there is no additional cost to establish the program, but potential costs to school districts cannot be determined. Department of Health personnel have not yet calculated an exact cost related to the provisions of the measure, but do anticipate a fiscal impact.

Disabled Pension Savings Exemptions The measure, also known as “Fred’s Law,” contains a number of provisions related to Oklahoma Achieving a Better Life Experience (ABLE) accounts, including directing the State Treasurer to facilitate access to a qualified ABLE program, elective administration of an ABLE program by the State Treasurer and/or joining a consortium for the same purpose, authorizing the Treasurer to contract with a third party for account management and develop a fee schedule, account requirements, prohibiting ABLE funds to be considered in determination of eligibility for certain assistance or benefits (including Temporary Assistance for Needy Families, or TANF), and exempting account balances and distributions from levies. Regarding the calculation of TANF benefits, any potential impact on the TANF program will depend on the number of participating individuals and the level of account contributions. According to the Tax Commission, a minimal decrease in income tax collections is anticipated for FY-18 as a result of these provisions. Fees assessed by the Treasurer are to be sufficient to offset administrative and staffing costs associated with implementation and administration of the program.

Unemployment Claims By Seasonal Workers The Conference Committee Substitute for HB 3164 provides that a worker’s unemployment benefits based on seasonal employment are payable only for weeks of unemployment occurring during the normal seasonal work period. The measure further provides that no benefits shall be paid for the period between two normal seasonal work periods if reasonable assurance is given that the individual will return to work in the second of those periods, but provides for retroactive benefits if the individual does not return to work in the second work period. The bill allows for an employer may apply for designation as a seasonal employer no less than 20 days before the start of a seasonal work period, and if that status is granted, the employer must notify each employee of that status and of the beginning and ending dates of the normal seasonal work periods. The employer is also required to give notice of reasonable assurance of employment for the next season on or before the last work day in a season.

Sodomy Law Expanded The Conference Committee Substitute to HB 2398 creates the Justice for J.W. Act of 2016. The measure provides that the term “force” shall mean any force necessary to accomplish the act of sexual assault without the consent of the victim. The Court of Criminal Appeals is to publish a uniform jury instruction for jury trials defining the term “force”. The measure defines the term “sexual assault”. The measure defines the term “consent”. The measure provides that the crime of sodomy has occurred if the person is at the time unconscious of the nature of the act or if the person is intoxicated by a narcotic or anesthetic agent administered by the accused.

Teacher Certification Expanded The bill requires the State Board of Education to issue a teaching certificate to an individual holding an out-of-country certificate who meets all requirements established by the Board and to an individual who successfully completes a competency exam that is used in a majority of the states or comparable customized exam and meets all other requirements. The measure deletes the 5 year teaching experience requirement for individuals holding an out-of-state or out-of-country teaching certificate. The Board will accept teaching experience from out-of-country schools that are accredited or otherwise endorsed nationally or regionally, and from primary and secondary schools that are operated by the Department of Defense or are affiliated with the U.S. Department of State.

Voter Registration Verification SB 1016 directs the Secretary of the State Election Board to compare the driver license or identification card record with the information contained on a voter registration application submitted electronically to ensure that they substantially match. The measure also extends statutory provisions regarding confidentiality of personal information within driver records to the information obtained by the State Election Board and requires the Board to keep a full or partial Social Security number or driver license number confidential.
